Brazil's Supreme Court (STF) will have to decide if the Criminal Misdemeanors Act of 1941 is compatible with the Constitution or not and, therefore, whether the exploitation of gambling should be illegal in Brazil. The debate began in 2021 but was postponed with no set date for its return, making it possible that the matter is only resolved in 2025.

The specific case to be examined is the Extraordinary Appeal (RE) 966177, in which the Public Ministry of Rio Grande do Sul questions a ruling of the Appeals Panel of the Special Criminal Courts in the state. The ruling considered the conduct of exploiting gambling to be atypical but disregarded it as a criminal misdemeanor because the ban might not be in line with current constitutional principles.

If by the December 2025 recess of the Brazilian Judiciary branch, STF decides to comply with Extraordinary Appeal 966177, in favor of disregarding the practice of exploiting gambling as a misdemeanor, this market will resolve to "Yes".

If the Court decriminalizes some but not all forms of gambling, Futuur will use its discretion to determine whether this constitutes a 'Yes' resolution
