Will Brazil's Supreme Court decide in favor of holding internet providers and websites responsible for offensive content?
Market Rules
In 2020, the then president of Brazil's Supreme Court (STF), justice Dias Toffoli, and its vice president, justice Luiz Fux, suspended the public hearings that would discuss the Brazilian Civil Rights Framework for the Internet, initially scheduled for March that year. The discussion about the so-called Civil Rights Framework for the Internet is the subject of Extraordinary Appeals (REs) 1037396 and 1057258. The appeals at stake deal with the responsibility of companies that host websites to inspect published content and remove them from the air, without judicial intervention, when they are considered offensive.
If STF rules that internet providers, websites, and social network application managers can be liable for damages resulting from unlawful acts carried out by third parties, even if there is no prior and specific court order for the exclusion of content, this market will be resolved as "Yes".
(Note from the editor: If the Extraordinary Appeals are not judged by the end of 2022, this market will be canceled and all active wagers will be returned to forecasters)
