A series of media stories disclosing US Supreme Court justice Clarence Thomas’ links to the billionaire campaign donor Harlan Crow reignited public debate on the accountability of the justices for conflict of interest and other breaches in the judicial ethical code. Even though the Constitution allows impeachment and there are non-binding Judiciary codes of conduct, some observers perceive a lack of laws to enforce justices’ good behavior.
If a binding federal norm — such as a code of ethics — that allows the Executive or legislative branch to enforce consequences to breaches committed by US Supreme Court justices is approved in Congress by December 31st, 2024, this market will resolve to“Yes”.
