Section 230 of the Communications Decency Act (CDA) of 1996 is a piece of American Internet legislation, which provides immunity from legal liability for publishers from third-party content. The legislation separates hosts, republishers, providers, and other intermediaries of internet content from publishers and speakers.
Section 230 is a controversial topic since it has been the legal ground for the exemption of liability of big online platforms such as Facebook and Twitter from the spread of misinformation or 'hateful' content inside their communities of users. On the other hand, the Electronic Frontier Foundation describes it as “one of the most valuable tools for protecting freedom of expression and innovation on the Internet”.
Many politicians, including Joe Biden, have argued that Section 230 should be revoked.
If by December 31, 2024, the Communications Decency Act gets annulled or canceled – no matter if in its entirety or only partially – this market will resolve to “Yes”, regardless of whether or not the legislation is replaced by a different new legal disposition.
